If you are using the Services on behalf of a legal entity, you represent that you have the authority to bind that entity to these Terms.

1. Definitions

"Company," "we," "us," or "our" means Big Tiny Story, a company incorporated in Israel.
"You" or "Customer" means the individual using the Services.
"Content" means any data, images, text, or information you provide.
"Platform" means our personalized gift book platform.
"Services" means our web and mobile applications, book creation tools, and support services.
"Third Party Services" means services not operated by us but which may be integrated into our Platform (e.g., Google Analytics, Resend).

2. Use of Services

We grant you a limited, non-exclusive, non-transferable right to access and use our Services solely for personal and non-commercial purposes.

You agree not to:

Use the Services for any unlawful purpose;
Interfere with or disrupt the operation of the Platform;
Upload content that is defamatory, obscene, or violates any third-party rights;
Resell, distribute, or copy any part of the Services.

3. AI-Generated Content

Some features of the Services include AI-generated text or illustrations. You agree to:

Provide accurate and lawful data (e.g., child’s name, images);
Be responsible for the accuracy, legality, and privacy compliance of all content you upload;
Acknowledge that AI outputs may be reused, non-unique, or imperfect.

We use third-party models but do not allow your content to be used for model training.

4. Your Content

You retain all rights to your uploaded content. You grant us a non-exclusive, worldwide license to use it for:

Providing and improving our Services;
Generating personalized books;
Customer support.

We do not use your private content for marketing without consent.

We are not a data storage provider. Please keep your own backups.

5. Payment & Fees

All payments are processed via PayPal.
Prices are displayed in [currency, e.g., USD/NIS] and include applicable VAT unless stated otherwise.
All sales are final unless otherwise outlined in our Refund Policy.

6. Refund Policy

Please refer to our Refund & Returns Policy for eligibility and process. Customized or personalized books are non-refundable except for manufacturing defects.

7. Intellectual Property

All rights, title, and interest in the Platform, including software, design, and content (excluding user-generated content) belong to Big Tiny Story. You may not copy, modify, or distribute any part of our Services without our permission.

8. Termination

We reserve the right to suspend or terminate your access to the Services if:

You violate these Terms;
We are required to by law or security concern.

You may stop using the Services at any time.

9. Limitation of Liability

To the extent permitted by law, Big Tiny Story is not liable for:

Any indirect, incidental, or consequential damages;
Loss of data, revenue, or profits;
Damages exceeding the amount paid by you in the 12 months preceding the claim.

10. Indemnity

You agree to indemnify and hold harmless Big Tiny Story from any claims, losses, or damages arising out of:

Your misuse of the Services;
Your violation of laws or third-party rights.

11. Governing Law

These Terms are governed by the laws of the State of Israel. Any disputes shall be resolved in the courts of Tel Aviv.

12. Changes to Terms

We may update these Terms occasionally. Updated versions will be posted on our website. Continued use of the Services indicates acceptance of the new Terms.
